Abstract

The study aims to explain: (1) business legalization regulations for business actors in e-commerce as reviewed by Permendag No. 31/2023; and (2) forms of legal protection for consumers in buying and selling in e-commerce. This research was conducted using normative legal research (normative legal research method). This study uses legal material sources in the form of laws and regulations and is supported by secondary data obtained through literature studies consisting of primary, secondary, and tertiary legal materials. The research resulted in the conclusions that: (1) The regulation of business legalization for business actors in e-commerce as reviewed from Permendag No. 31/2023 is that "Business Actors are required to obtain Business Licenses in each sector, in accordance with the laws and regulations governing the implementation of risk-based Business Licensing" in accordance with Government Regulation Number 80 of 2019 concerning Trade Through Electronic Systems and Regulation of the Minister of Communication and Information Number 5 of 2020 concerning Private Electronic System Organizers; dan (2) The form of legal protection for consumers in buying and selling through e-commerce is based on the principle of preventive and repressive legal protection. The form of legal protection for consumers is regulated in Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions, Law Number 8 of 1999 concerning Consumer Protection, Law Number 7 of 2014 concerning Trade, Government Regulation Number 80 of 2019 concerning Trade Through Electronic Systems and in Book III Article 1234-1252 of the Civil Code concerning default.
