Abstract

This research examines the effectiveness of law enforcement against perpetrators of Domestic Violence (KDRT) committed by military personnel, focusing on a case study at Kodim 0720/Rembang. Although Indonesia has enacted Law Number 23 of 2004 concerning the Elimination of Domestic Violence (UU PKDRT), its implementation within the military environment faces numerous obstacles. One of the main barriers is the dualism between civil and military judicial systems, which often impedes justice for victims. Factors such as patriarchal culture, weak victim protection, poor inter-agency coordination, and the dominance of internal disciplinary mechanisms contribute to the ineffectiveness. This study employs an empirical juridical method with a qualitative approach. Data were obtained through interviews with domestic violence victims, legal practitioners, and analysis of legal documents and academic literature. The results indicate that cases of domestic violence involving military personnel are often resolved internally without transparent judicial proceedings, failing to deter offenders and neglecting victims’ rights to justice. From the Islamic legal perspective, domestic violence contradicts the principles of compassion and justice within family life as outlined in the Qur'an. Therefore, strict and transparent sanctions must be applied to perpetrators regardless of their status. The research recommends stronger coordination between military and civil courts, proportional sanctions for offenders, and enhanced legal protection for victims within military circles.
